I. General Terms and Conditions

§ 1 Basic Provisions

  1. The following terms and conditions apply to all contracts concluded with us, Nico Lauer, via the website https://aaazyy-d0.myshopify.com/. Unless otherwise agreed, we do not accept any terms and conditions used by you.

  2. A consumer within the meaning of these provisions is any natural person who enters into a legal transaction for purposes that predominantly are outside their trade, business, or profession.
    An entrepreneur is any natural or legal person or a partnership with legal capacity who, when entering into a legal transaction, acts in the exercise of their independent professional or commercial activity.

§ 2 Conclusion of Contract

  1. The subject of the contract is the sale of goods.

  2. By listing a product on our website, we make a binding offer to conclude a contract for that item under the conditions specified in the product description.

  3. The contract is concluded via our online shopping cart system as follows:
    Products intended for purchase are placed in the shopping cart.
    You can access the shopping cart at any time and make changes.
    After clicking the "Checkout" button and entering personal, payment, and shipping details, a summary of your order will be displayed.

If you select an instant payment system (e.g. PayPal, PayPal Checkout, Amazon Pay, Sofort), you will either be directed to an order summary page in our store or to the payment provider’s page.
After entering your details and confirming the payment, you will be redirected back to our website or see the order summary on the payment provider’s page.

Before submitting the order, you can review and correct your details or cancel the order.

By clicking the button labeled "Buy now", "Order with obligation to pay", or similar, you accept the offer, and the contract becomes legally binding.

  1. Order processing and all necessary contract information are transmitted via email, partly automatically.
    Please ensure that the email address provided is correct and that you can receive our emails (especially not blocked by spam filters).

§ 3 Special Agreements for Offered Payment Methods

  1. Payment via PayPal / PayPal Checkout
    Payment is processed through PayPal (Europe) S.à r.l. et Cie, S.C.A., 22-24 Boulevard Royal, L-2449 Luxembourg.
    The available PayPal payment methods are shown during checkout. PayPal may use other payment providers; if specific terms apply, you will be informed separately.

    Payment is processed through Mollie B.V., Keizersgracht 313, 1016 EE Amsterdam, Netherlands.

§ 4 Right of Retention, Retention of Title

  1. You may only exercise a right of retention if it arises from the same contractual relationship.

  2. The goods remain our property until payment has been made in full.

§ 5 Warranty

  1. Statutory warranty rights apply.

  2. Consumers are requested to check the goods immediately upon delivery for completeness and visible damage and to notify us and the carrier of any issues as soon as possible.
    Failure to do so will not affect your statutory warranty rights.

  3. Any deviation of product characteristics from objective requirements shall only be deemed agreed if we informed you prior to contract conclusion and you expressly consented.

§ 6 Choice of Law

  1. German law shall apply.
    For consumers, this applies only insofar as it does not deprive them of the protection granted by mandatory provisions of the law of the country where they habitually reside.

  2. The UN Convention on Contracts for the International Sale of Goods (CISG) does not apply.

§ 7 Youth Protection

  1. We only enter into contracts with customers who have reached the legal minimum age for products subject to the Youth Protection Act.
    Age restrictions are specified in the respective product description.

  2. By submitting an order, you confirm that you meet the required legal age and that your personal details are accurate.

  3. Where required by law, the delivery service is instructed to deliver only to persons who meet the legal age requirement and may request valid ID for verification.

  4. If an item requires the buyer to be 18 or older, this replaces the legal minimum age requirement.

3. Contract Language and Storage

3.1. The contract language is German.
3.2. The full contract text is not stored by us.
Before placing your order, you can print or save the contract details via your browser.
After submitting the order, you will receive the order details and these Terms and Conditions via email.

4. Main Characteristics of Goods and Services

The main features of the goods and/or services are provided in the respective product description.

5. Prices and Payment Terms

5.1. All prices include applicable VAT and all other price components.
5.2. Shipping costs are displayed separately during checkout and must be paid by you unless free shipping is indicated.
5.3. For deliveries outside the EU, additional costs such as customs duties, taxes, or transfer fees may apply and must be paid by the customer.
5.4. For payments from outside the EU, any bank or exchange fees are also borne by the customer.
5.5. Available payment methods are shown on our website and during checkout.
5.6. Unless otherwise stated, payment is due immediately after conclusion of the contract.

6. Delivery Conditions

6.1. Delivery conditions, delivery times, and possible restrictions are displayed on our website and in each offer.
6.2. The risk of accidental loss or deterioration of the goods passes to the consumer only upon receipt of the goods.

7. Legal Warranty Rights

Warranty rights follow the provisions stated in §5 of our General Terms and Conditions (Part I).
